Photographs are classified under Artistic works which are eligible for copyright protection by virtue of Section 2 (1) of the Copyright Act, 2022. The Act in ascertaining the first ownership of copyright in artistic works states that copyright in such works shall initially vest in the author of the work except as otherwise provided in an agreement. Section 108 of the Copyright Act 2022 defines an author in the case of a photographic work as the person who took the photograph.
